正當疫情再次襲來之際,許多都市人也遠走郊區, 因而全美許多大都市都有著空前高的房屋空置率 。 例如紐約市寸土寸金的曼哈頓租房空置率比去年同期上升了超過兩倍,出售房空置率也飆升2–3倍 (去年同期才不到2%,現在則有超過5%),曼哈頓租金雖有下降約10%,賣價也下跌了15–17%;又例如另一個都市居大不易的代表舊金山,房價也比去年同期稍微下降1.5% (而其周遭的矽谷郊區地帶卻房價上升三成)。 雖然空屋率飆升,但房屋價格卻沒有像經濟學課本裡的供需曲線一樣應聲下跌,雖有向下探但顯然對許多人來說跌的還不夠、還是一樣難以負擔得起,對於許多人來說紐約曼哈頓本島隨便一室一廳就四、五千元月租起跳的租金仍讓人望之卻步;而在今年第三季舊金山出售的房子中,只有9%是舊金山中等收入(Area Medium Income)家庭能夠負擔的,順道一提收入中等家庭在舊金山指的是年收13萬美金。 ... 究竟什麼時候開始房子開始貴得住不起? 如果以租金與收入的比例來看,普遍認為如果 租房支出超過總收入的30%就屬於「租金負擔重(rent-burdened)」 。 在美國大都市地

驅趕暫停令無限延期,疫情期間房東拿房客沒辦法?
全美新冠疫情持續發燒,紐約雖然疫情趨緩,但難保在逐漸開放之下不會像其他州疫情重新反撲,尤其現在時序進入秋冬、新冠疫情可能與流感一同肆虐帶來更嚴重的影響。 在這種時候,房東們眼看驅趕似乎遙遙無期,又該如何處理難纏又欠租的租客呢?以下我們盤點幾個目前的法律規範以及法庭情況: 商業租客: 根據州長庫莫最新在9/21/20發布的最新命令, 商業租客的欠租驅趕繼續暫停到10/20/20 ; 住宅的 Holdover(租期終止)驅趕訴訟可以正常進行 ,至於欠租類型訴訟可以受審,但是如因疫情因素經濟受到影響,則房東在「租客避風港法案 ( Tenant Safe Harbor Act )」之下 只可以拿到金錢賠償判決 (Money Judgment)、不能以欠租為理由驅趕,欠租驅趕暫停到1/1/2021 ; 紐約州上州、長島等各法院陸續開始有限度的開庭,除了紐約市以外;長島 Nassau County法院 目前收受疫情後的新案子,但最早都是10月底/11月才能開庭並且可能被行政延庭; 紐約市法院 目前也開始收新案件,但沒有給出具體庭期; 3/17/2020疫情前

新冠疫情使得很多商鋪關門,租客紛紛要求房東減租。(美聯社) 許多旅館生意冷清,房間閒置。(美聯社) COVID-19病毒疫情已經升級成全球性的危機,紐約州在這風暴當中,也很慘烈地榮升全美國、甚至是全世界第一重災地。在疫情伊始美國股市應聲一日熔斷兩次,房地產市場的投資者 — — 也就是房東們,也體驗到租客不交租、在各州政府命令下無法驅趕房客,資產價值受損、投資回報下跌的苦果。隨著疫情發酵,更讓房東與房客們無所適從的,是聯邦與各州政府不斷更新的法規與命令。 然而從投資的角度來看,投資本來有賺有賠,股市在3月下旬尚且蒸發約三成市值,現在雖然緩步回升但也比疫情前少了一成多;相較來說房產投資如果少了半年租金,以美國平均房價與月租比(也就是房價相當於多少個月的租金)來說,主要都會區在2019年已經達到將近40,也就是說房屋投資至少要三年多以上才可能回本,這還是在沒有計算任何相關支出的情況下。以這樣的數值而言,少了半年租金大概是資產回報減少15%左右,似乎也大致反映股票市場狀況。 在這場罕見的危機中,在重重州長各種「暫停」令、在家工作潮、聯邦補貼轟炸,以及紐約

州长下令驱赶暂停延期到8月20日,人心惶惶的纽约房东该如何应对呢?以下是行动重点摘要: 尽快发送30/60/90天租期终止通知,这样可以为未来要发起的驱逐诉讼争取时间。 立刻跟租客展开协商,可以协商减租、用押金抵扣房租,记住要有书面协议。 保留租客欠租的书面记录(短信、邮件、书信等)。 州长颁布禁制驱赶令延长至8月20日 疫情虽然在纽约「暂停」之下看似驱赶,但经济面的影响却深远宏大。5月7日州长颁布了禁止驱赶房客的最新禁制令,包含以下主要内容: 对于领取失业救济金以及因为新冠肺炎而有经济困难的房客,禁制驱赶令由6月20日延长至8月20日; 对于欠租的房客,房东可以通过书面协商的方式用房客的押金(security deposit)来抵扣欠缴的房租,并且房客需要在90天后开始交还押金。然而,禁制令允许房客在12个月内慢慢交齐押金。 3月20日到8月20日期间,对于欠租的租客,房东不可以收迟交费(late fee)。 对于领取失业救济金以及因为新冠肺炎而有经济困难的房客,不允许在房屋法庭提起欠租程序(nonpayment proceeding)。...
